Probe finds no willful policy breaches by fire crew in Florida train crash

VIDEO/PHOTOS: The Delray Beach firefighters who were in a crash involving a Brightline train back in December did not willfully or maliciously violate any city or Fire Rescue policies, an administrative investigation into the incident found. The city of Delray Beach announced on Tuesday, that Johnson Jackson PLLC had completed their investigation which examined whether fire department personnel operated fire engines without having a valid driver’s license. The investigation found there was no evidence of “willful, wanton or malicious intent by any personnel to violate City or Fire Rescue policies.” On December 28 a fire engine was struck by a Brightline train as it tried to cross the tracks with the guardrail down. The crash led to four Delray Beach firefighters being placed on administrative leave while the investigation was underway. Following the investigation, Division Chief Todd Lynch returned to work on Tuesday and he will be reinstated as a battalion chief within 45 days. Calvin Smith, a firefighter with Delray Beach Fire Rescue, was found to have operated without a valid license for an extended period, but took corrective action when he discovered the issue.
